REFUND OF GUARANTEE DEPOSIT
If the tenant has returned all the keys to the apartment, handed over the apartment cleaned and in a normal condition and paid all rents and other payments, the landlord will refund the guarantee deposit on the account indicated by the tenant at the latest one month after the tenancy agreement end date.
Guarantee is apartment-specific
The guarantee paid for an apartment is
apartment-specific. If only one party to the tenancy agreement moves away from
the apartment, the deposit will not be refunded before the other party also
moves away. In these cases, the parties in question must agree between
themselves on what to do with the guarantee deposit.
Use of guarantee deposit and refund
If a defect, untidiness, etc. that will
cause the tenant expenses to rectify is detected during the apartment's
condition inspection, the landlord may use the guarantee deposit to paying for
costs incurred to the tenant without hearing the tenant.
- The landlord may withhold a sum based on the tenancy price list from the deposit.
- The landlord may reserve the guarantee deposit as long as the company performing the work has presented a separate invoice for the work and the issue has been processed by the landlord.
No interest shall be payable for the guarantee deposit.
